DraftKings Settles $10M Lawsuit Over Unregistered NFTs

DraftKings has agreed to settle a class-action lawsuit for $10M over the sale of unregistered securities through its NFT marketplace.

• The lawsuit, filed in March 2023, claimed that DraftKings' NFTs were investment contracts and should have been registered under US securities laws.

• Lead plaintiff Justin Dufoe, who lost $14K in the NFT marketplace, is expected to receive a $50K award for his efforts in the case.

• Such a settlement was reached after extensive mediation and discussions following DraftKings' NFT marketplace's closure, which rendered the digital assets worthless.

• Also, regarding unregistered securities, the SEC recently dropped lawsuits against Kraken and Yuga Labs' BAYC, which dates back to before the Trump administration.
